INTERVENTION

GENERAL AND SPECIFIC OBJECTIVES

 

1 OVERALL OBJECTIVE

The celebration of a CONSTITUENT MEETING OF MEXICO to deal with the political affairs of the country, which is legally admitted and justified in article 9 of both constitutions of the United Mexican States, that of 1857 and 1917.

2 SPECIFIC OBJECTIVES

I.- Put into practice an action or activity consisting of a CONSTITUENT MEETING OF MEXICO, in order to perfect the execution of the second part of the hypothesis of article 128 of the Constitution of the United Mexican States of 1857, consisting of 3 actions:

 

1.- Recover the freedom of the people;

 

2.- Reestablish the constitutional order of the Republic; Y,

 

3.- To judge according to the laws, those who had figured and cooperated in the governments emanating from the military and revolutionary rebellions.

 

II.- Test the development of a CONSTITUENT MEETING OF MEXICO, to determine if it can function or result in the manner desired, in the exercise of the action to alter or modify the form of government established in article 39 of the Constitution of the United Mexican States of 1857 consisting of 2 actions:

 

1.- Change the form of government towards a more highly democratic one called DEMARQUIA.

 

2.- Change the form of government towards an Ambidextrous State of political centrism.

ABSTRACT

 

 

It is imperative to examine the situation of the sovereign authority of the Mexican people after the military and revolutionary rebellions, the constitutional law, the Supreme Court and the Attorney General’s Office; make an account of damages on the rules broken by the intruders, promote a call to the nation to restore the constitutional order of the Republic and change the form of the government system towards demarchy and political centrism or ambidextrous State, then, a proposal to specify the legally admissible objective of a “Constituent Meeting of Mexico” for the implementation of a: “Resistance Plan of the Mexican Nation against the revolutionary State”.

 

 

 

ADVANTAGES OF THE INTERVENTION

 

 

 

1.- PUT INTO PRACTICE THE USE OF THE RIGHT TO EXERCISE THE SOVEREIGN AUTHORITY OF A PEOPLE.

 

The national sovereignty or power to activate its power of command and action of authority according to article 39 of the Constitution is deposited in the people.

 

“Article 39.- National sovereignty resides essentially and originally in the people. All public power emanates from the people, and is instituted for their benefit. The people have at all times the inalienable right to alter or modify the form of their government.”

 

From the above legal provision we understand that a people is “sovereign” and is in possession of a social omnipotence: All rights are theirs; otherwise it would not be omnipotent; and not being omnipotent it would not be sovereign. For the same reason all obligations are outside of him; because if he had any obligation to fulfill, he would be a subject: sovereign is he who commands, subject is he who obeys; Sovereign is he who has rights, subject he who has obligations. Thus the principle of popular sovereignty, which is an atheist principle, is also a tyrannical principle, because where there is a subject and he has no rights, and a sovereign who has no obligations, there is tyranny. This forces us to understand the reality regarding the sovereignty or authority of a people against their representatives in government.

 

The principle of popular sovereignty does not recognize reciprocity in rights or limitation in obligations. The idea of ​​just disappears where there are only masters and slaves: from here it turns out that the principle of sovereignty, being atheist and tyrannical, is also an immoral principle, because it destroys justice. It is so true that justice and popular sovereignty cannot coexist in the world, that, once the existence of the first is recognized, the second is annihilated, because if the people can only do what justice demands of them, the people are subjects and justice is sovereign, before this truth, the sovereignty of the people is an absurdity.

 

If sovereignty resides in the general will, and the general will is the collection of particular wills, all individuals must have a part of sovereign power: if sovereign power is realized only through laws, all individuals still minors must have an active part in the making of laws. The ignorant, for example, have the same rights as the wise, because they have a will like them: women have the same rights as men, because they have a will like them: children have the same rights as parents, because they have a will like them: the proletarians have the same rights as the powerful, because they have a will like them: in short, the insane must claim a part of their sovereignty, because heaven denying them reason, I do not deprive them of the will and the will makes them sovereign too.

 

Sovereignty of the people is an empty word. What idea does the people have of its sovereignty? Is it that of the source of authority? And how does it communicate it? And what does it reserve? And how is it contained in all of it? And by what right could it reside in any of its parts? How can it be redeemed from the inevitable inconveniences of its nature? then, with this the individual is essentially strong, powerful, free, one: then, in his will, all de facto inconveniences expire, and in his reason, all those of right: then, is it intransmissible or perishable? because if it is transmitted, what is left for the people? If it is not transmitted, then the government is a usurpation, or it is an irony. Does it come from elsewhere? But from where? Is it divisible? What is its numerical ratio with respect to each person? What is its appreciative value in each nation? each individual?, for example: When twenty thousand perish in a battle, how is sovereignty left?, do its modifications follow the ratio of those born and dead in the population census?, where is sovereignty if the intruders of a military or revolutionary rebellion?

 

In the case of the Mexican Republic, the intruding rebel military coup leaders and revolutionaries of 1876 and 1910, by force of arms, usurped the powers of the Mexican Republic and implanted governments contrary to the principles enshrined in the legitimate Constitution and still in force from 1857.

 

If an authority is illegal then it is not an authority, then; before the usurpation of the power on the part of the intruders: Who restores the legality in the middle of the anarchy?; Who organizes the procedure that tends to make the impostor governments of the intruding revolutionary State disappear? Who issues the call from which a legitimate government is born again? Who resumes the tradition of legitimacy in the new government?

 

2.- THE EXERCISE AND RECOGNITION OF THE OBLIGATIONS OF MEXICAN CITIZENS.

 

Based on article 31-I of the legitimate Constitution of 1857, Mexicans have the obligation to:

 

“to ensure the independence, territory, honor, rights and interests of their country.”

 

One of these obligations is to comply with the constitutional mission established in article 128 of the legitimate Constitution of 1857, which establishes the realization of the constitutional mission of defending the rights and interests of the country, such as the following: 1.- Recover the freedom of the village; 2.- Reestablish the constitutional order of the Republic; and, 3.- Judge according to the laws, those who had figured and cooperated in the governments emanating from the military and revolutionary rebellions.

 

With regard to article 39 of the Constitution, the current form of the false “system of the democratic regime”, we find that the electoral processes do not meet the requirement of the mathematical formula of the will of the majority, which consists of obtaining half plus one of votes of the total number of voters registered in the electoral roll, in contrast they imposed on us a method or modality called: “relative majority and proportional representation”, completely invalid because it is alien to the guiding numerical principle of democracy.

 

3.- THE POSSIBILITY OF PRACTICING AND PROOFING THE EFFECTIVENESS OF THE RIGHT TO COUNTER-REVOLUTIONARY RESISTANCE.

“What is a counterrevolution”:

 

“It is the citizen movement that opposes the validity or permanence of a revolutionary State is what is called counterrevolution. Its social foundation is that every revolution alters the logical process of participation, representation and tolerance. The counterrevolution is born from the very moment that a revolution triumphs and establishes as a form of State some principles that aspire to remain unchanged, which violates social initiative so that the representative majorities are the ones who permanently enjoy the mandate to make the State as in each moment the citizens want it”.

 

4.- THE POSSIBILITY OF MODIFYING THE FORM OF GOVERNMENT FOR THE BENEFIT OF THE MEXICAN PEOPLE:

 

The new model or more highly democratic system:

 

The DEMARQUIA also called “Consensus Conferences” would deliberate and make decisions on public policies in the same way that juries reach verdicts in criminal cases, in this case, on all kinds of matters that concern the State. “DEMARKY” attempts to overcome some of the functional problems of conventional representative democracies, which in practice have been subject to manipulation by special interests and which pose a division among professional politicians (including in this category those who are part of interest groups) and a basically passive electorate, disengaged, not very involved and often uninformed. According to Professor John Burnheim, the random election of policy makers would make it easier for ordinary citizens to participate and would make it more difficult for those with an interest in corrupting electoral processes.

 

“The “Demarchy” is a system that aims to change representative democracy or democracy of a few intermediaries, for direct democracy that guarantees the inclusion of all individuals in electoral processes.”

 

The most highly democratic system of the “DEMARKY” offers the following advantages:

 

1.- Society learns by doing government tasks directly, there is orderly deliberation, social participation, independence of assembly members, diversity of opinions, decentralization and aggregation of many. 2.- Decision making is more sensible and intelligent. 3.- Democracy is perfected, because a framework of collective understanding is created. 4.- Disappearance of the segmentation and polarization exerted by the parties. 5.- The parties will be replaced by assemblies. 6.- New citizen values ​​will appear at the service of the solution of collective problems. 7.- There will be a qualitative change in the citizen mentality. 8.- Decisions that affect the general interest will be avoided. 9.- There will be a collective identity around the common good of the community, a people led by reason and the common sense of equals is better disposed to respect the legal framework, when solutions spread horizontally and not from top to bottom. 10.- We will have electoral processes free of any cost. 11.- The ideology of the speakers will be varied and plural instead of closed. 12.- The social representation and the level of study of the issues will be broader. 13.- Leadership is shared instead of unique or oligarchic. 14.- The prestige and trustworthiness of the citizens will be of a higher quality than what is now offered by party politicians. 15.- Absences, waste of time and gradual relaxation of decision makers are avoided. 16.- The decisions of the matters will be impartial. 17.- Power is distributed instead of concentrated. 18.- Loyalty is with oneself and not with a party or its leaders. 19.- Group confrontations are avoided because there are no groups. 20.- In the solution of issues, a collective victory is obtained and not a group or party victory. 21.- The working method is collaborative instead of corporate. 22.- Human ethics aimed at helping humanity will be present instead of absent. 23.- There will be important social changes that transform the old that we already know. 24.- Avoid radical extremism. 25.- Avoid false democracies called “relative” or “proportional” designed to avoid the election of the majority of a people.

 

5.- THE POSSIBILITY OF MODIFYING THE POLITICAL SYSTEM TOWARDS A LATERAL POSITION CALLED POLITICAL CENTRISM OR AMBIDEXTROUS STATE.

 

POLITICAL CENTRISM: As a new, more effective model that avoids extremes and discrepancies.

 

Definition: POLITICAL CENTRISM is the set of parties, policies, and/or ideologies, which is characterized by considering itself intermediate in the political spectrum, with respect to positions generally called right and left. The third position or platform of the political center consists of reconciling the postulates of the right and left, which generate the division and creating a new political philosophy of the center in which the two opposing currents converge in equality, this supposes overcoming the traditional bipolar ideological thought whose struggles have led us to polarization and consequently to ruin. It is argued that a phenomenon called “moral hemiplegia” occurs since, due to minds closed to pre-established principles of antagonistic doctrines, the legitimate actions of their counterparts are paralyzed, all because they do not have an open mind, in such a way that hopelessly locked up (trapped) in their own convictions, the possibilities of a joint development of both forces are neutralized. In this way, when the representatives of the parties in government preach and put into practice the capitalist philosophy, then the efforts of the socialists will be blocked and vice versa, a never-ending matter, which is inappropriate since it keeps the society perpetually segmented and polarized. civilian population of both doctrinal currents.

 

The misfortunes and disorders of the political life of the country are of public interest: If the Mexican people temporarily distributed all the powers, will this same people be able to recover everything they gave? And, as is the case that the usurpers founded a “revolutionary state”, they became owners of everything. The all-powerful and national sovereign called the “Mexican people” was stripped of its rights, its ancient thrones demolished, all its ancient constitutions smashed, all the great national wealth destroyed and all its “powers” ​​ruined, in short, rendered useless. In this way, in the name of the sovereign people, the “intrusive servants” the impostor rulers who emerged from coups and revolutions, became owners and lords of everything, even the people themselves.

 

No national or international court can be asked to change the form of our government; that it declare that the Constitution of 1917 should not be in force, that it resolve that the impostor revolutionary governments stop acting as such; that is asking for an impossible thing because it is not foreseen in the sphere of the law, that corresponds to the exclusive competence of civil society, (of the people); pretending that the impostors rectify is asking for the impossible, the sole request would deny the independence and the supreme authority of the Mexican people.

 

The forces of this Mexican people are so formidable, powerful and indestructible, but there is something that is “the force of the past” that refuses to die because great atrocities were committed in it, the past struggles slowly and painfully to vindicate itself, for serving as support in the present, is a force that contaminates feelings.

 

To the international community we say that our situation affects many regions of the world, we are eager to remedy things, the world needs to be patient with us and wait a little longer; that allows us to lay the foundations of a solid government, we have elements, and there is, above all, a powerful will to do so; Soon, instead of revolutionaries and politicians, we will give the world captains of industry, wise men, artists, and ambassadors of peace: because the human material of Mexicans is splendid, but it has not yet been carved.

 

REFLECTIONS

 

I.- The important thing is not to fall into the creation of another usurper government as illegitimate as the previous one of the revolutionary State.

 

II.- If it is that the Mexican people temporarily distributed all the powers, will this same people be able to recover everything they gave? And how is it the case that the supposed “representatives of the people” (the kidnappers of the revolutionary State) and lords of everything, even of the people themselves; They also strategically have the unconditional support of the armed forces of the army, of the judges and magistrates of the courts and tribunals, of the public treasury with all the money possible, and of the natural resources, of the national patrimony, which ensures the development of a brutal influence on the whole of civil society that is defenseless against such a potential enemy of the revolutionary State, however, our freedom is in the same law and justice will be done for it.

 

III.- We will be able to make the civil population aware of how to make effective the right not to be excluded, to dispose freely (without restrictions) of the will of a modern society, in making use of its prerogatives and its legal assets protected by the law as part of its patrimony, taking into account the capacity to act that the legal norms confer on individual legal persons, to be the holder of rights and obligations, as is the case of the alleged Counterrevolutionary Constitutional Constituent Meeting.

 

IV.- The all-powerful and national sovereign called the “Mexican people”, which was stripped of its rights, its ancient thrones demolished, all its ancient constitutions smashed, all the great national wealth destroyed and all its “powers” ruined, in end, useless. In this way, in the name of the sovereign people, the “intrusive servants” (the rulers that emerged from coups and revolutions) can no longer ever be the executioners of the Mexican people.

 

V.- The Constituent Meeting has projected in time a line that contains historical passages as an essential element to explain the improper behavior organized by the rebel and revolutionary military. The events of the past symbolize the movements or fluctuations that easily lead us to understand reality in certain periods of time (temporality), which are reflected as very representative of the rhythms of the phenomenon. The trends of the phenomena of the succession of power as information from the past have made it easier to work on the processes of focusing on the future, and in turn will facilitate healthy reflection, explanation and objective understanding of what happened.

 

VI.- The ideology of the Constituent Meeting is based on a thought inherent to the current objective conception of the world, seeking its transformation through interpretation, speculation, inquiry, analysis and reflections on the importance of the actions of man as a dynamic parameter of the change that is sought. The ways in which tomorrow is approached here seek to reduce the uncertainty about what destiny holds for humanity. It is also based on the situation of prevailing contemporary facts and examines them scientifically and objectively, in this process of analysis there is nothing utopian or futuristic or misleading, I have relied on legal science in such a way that I have obtained irrefutable axioms or forceful truths of greater weight, clarity and scope. Then the prospective proposal of the future made in this work, integrates concepts and processes that multiply the alternatives and diversify the possibilities.

 

VII.- This social project has been designed prospectively to be easily understood, it does not have a polemical or authoritarian tone, but neutral, it is not desired to come into conflict with those who rent their work for the State, nor is there any claim to fame or goods, it has not come to destroy governments or laws, but there is a desire to give all that its absolute fullness and legitimacy. It will be relatively understandable that this research report is mistrusted, but any doubts about it should be dispelled because in the development of the work I will explain the procedure by which I have reached such exact conclusions.

 

VIII.- It will be possible to make an appeal, consultation, and summons to examine the importance of the written configuration of a Counterrevolutionary Resistance Plan, in order to generate public interest in shaping the integration of the Constituent Meeting, for of course , recover freedom, strengthen the national sovereignty of the people and restore the constitutional order of the Mexican Republic.

 

IX.- The social project is currently important in the economic, political, social and cultural context of our country, since it constitutes a positive and clear vision towards the future, so that the individuals of civil society participate and become a decisive factor. in the development of the environment where they must act, and thus, achieve their new purposes that give sustenance to a government that is authentically of the people, and update the democratization of democracy in its maximum splendor.

 

X.- In order to reconquer our country Mexico, or what is the same, to recover our house from the possession of the intruding coup plotters and revolutionaries, we do not need cannons or bad intentions, it is enough to establish the force of reason in a certain type of agreements between its civilian population, so that everything runs smoothly in perfect balance. Societies that despise the truth and support ignorance are not a true civilization.

 

XI.- Before the community of nations around the world, those who know our laws and our history, we Mexicans appear as vulgar traitors, true cowards, weak and ignorant, we have eyes but we do not see, we have them open but Nothing is useful, because we are asleep, we do not activate our conscience, we have abandoned the natural struggle for survival and happiness, for various reasons our spirit and our mind lack the necessary ardor to start, change and stop a new Nation project at will, that inability prevents us from taking responsibility for what happens in our hands and we opt instead for the comfort of dishonor and shame, wishing to live forever as vile cowards until the last days of our lives.

 

XII.- Possibly these proposals by themselves do not cure all ills, but they can help to solve part of the problem; In this study I have not wanted to refer to problems such as: economic imbalance, discrimination, the situation of children, begging, vagrancy, prostitution, criminality, mortality, food, hygiene, ethnic groups, etc., I wanted to get to more delicate points such as answering the two questions: Are we Mexicans a people capable of governing itself? How do you explain that despite having so many revolutions and governments, it is not possible to build a country on solid foundations?

 

XIII.- Podemos tener la firme convicción de que el pueblo mexicano está capacitado para auto gobernarse por sí mismo y cuenta en su seno con los elementos para darse un gobierno digno de tal nombre. Si hasta hoy a pesar de sus esfuerzos no ha sido posible crear ese gobierno, se debe a la pesada carga de los poderes no visibles divergentes que se oponen a una organización social fundada en la razón y la justicia.

 

XIV.- Many years the people of Mexico lived under the slavery of Spanish foreigners, others more of military slavery of a dictatorship, followed by more slavery exercised by the rebels of 1910 who called themselves “revolutionaries”, and the most recent exercised by the phony accomplices and owners of the parties; however, despite all these adversities, our people have survived, they are still here, the politicians have been transitory, many of them are no longer here because they no longer have a position or salary from the government, vulgar people interested in money, vile businessmen and traffickers, players of the chessboard and not pieces of it, on the other hand, the people are still here because they have admirable qualities, sufficient resistance and adaptability to the difficult environment that is presented to us.

 

XV.- The forces of this Mexican people are so formidable, powerful and indestructible, but there is something that is “the force of the past” that refuses to die because great atrocities were committed in it, the past fights slowly and painfully for vindicating oneself, to serve as support in the present, is a force that contaminates the feelings of any researcher. George Washington once said: “Government founded on force and fear is like fire, at the same time servant, dangerous and terrible tyrant. Never for a moment leave the government in irresponsible hands.”

 

XVI.- Every impostor regime is a regression and all those who cooperate with the rebels who usurp the government have no choice but to expose themselves to the just consequences of their betrayal.

 

XVII.- It would be useless to hasten events; a peace with an impostor dictator with an iron fist would be but a short truce with a more violent relapse. The internal peace of our country cannot be achieved except on the basis of reason and the justice of the laws.
